The Sole Agency Safe seal
The SOLE AGENCY-SAFE Seal is awarded to Internet Property Advertisers who have declared their adherence to a code of practice ensuring that their activities do not include anything which may be construed as an ‘Agent Duty’ as defined by regulatory authorities such as the Office of Fair Trading. SOLE AGENCY-SAFE accredited members are therefore NOT acting as ‘Agents’ in the sale.
The APA will consult with the OFT on a regular basis in order to protect the status of members and to ensure their right to trade as Internet Property Advertisers.
Individual APA member’s adherence to these conditions is monitored on a regular basis to ensure ongoing compliance with the code of practice.
Compliance with the code of practice means that the APA member website cannot be construed as performing ‘Agent Duties’. Users advertising on the site and using the website services can therefore do so with confidence that they will not be liable to pay a fee to a concurrently-instructed Estate Agent with whom they have signed a ‘Sole Agent’ or ‘Sole Agency’ agreement if the Agent is not responsible for the introduction of the prospective buyer.
